Eden Kitchens & Bathrooms Terms & Conditions – Design, Supply & Installation

These Terms & Conditions set out the terms on which Eden Kitchens & Bathrooms (“we”, “us”, “our”) provide design services (“Design”), supply goods (“Goods”), and perform installation services (“Installation”) as a full service to you (the “customer”). These Terms & Conditions do not affect your statutory rights.

By placing a deposit or an order for Goods, Design or Installation services from Eden Kitchens & Bathrooms, you agree to be bound by these Terms & Conditions. SUMMARY

  • Dates & Lead Times are given in good faith but may change due to events beyond our control.

  • Delivery: We will notify you of expected delivery dates near the time of installation; you must ensure that access is suitable.

  • Colour Match: We strive for accurate colour matching, but the limits of manufacturing and natural material variation (e.g. woods, ceramics, acrylics) apply.

  • CAD Drawings & Layouts are guides only; final checks will be made by installers on site.

  • Returns Summary:
    • You have 14 days from the day after delivery to return unopened goods for credit, refund or exchange (subject to exclusions).
    • Opened or installed products generally cannot be returned.
    • Tiles and wall panels cannot be returned once delivered (due to wastage, batch matching, etc.).
    • Glass items (shower enclosures, bath screens) cannot be returned if opened, unless faulty.
    • Returned items must be in original, undamaged packaging, resalable, with no signs of installation.
    • You are responsible for return shipping.
    • Refunds processed 14 days after we receive and inspect returned goods.

These Terms & Conditions do not affect your statutory rights.

DESIGN TERMS & CONDITIONS

  • Design Concept: Based on the information you provide, we will create a design concept (sketches, 3D renderings, material samples) consistent with your objectives.

  • Design Revisions: We include a certain number of revisions; further revisions may incur additional fees.

  • Approvals: Once you approve the design concept, we will issue a proposal with scope, materials and costs. Paying a deposit or placing an order confirms your acceptance of that proposal and our Terms & Conditions.

  • Design Fee: A non-refundable design fee is payable at theend of the design process. This amount will be credited toward the final order.

  • Ownership & Copyright: All design materials, drawings and associated intellectual property remain our property. Unauthorized use or reproduction is prohibited.

  • Liability: Design visuals are conceptual; they do not replace structural, architectural or technical plans you may need from third parties (e.g. structural engineers).

  • Confidentiality: We will treat all project information as confidential. Unless otherwise agreed in writing, we may show the completed design in our portfolio or marketing materials.

1. INTERPRETATION

1.1 In these Terms & Conditions:
1.1.1 “Conditions” means these terms & conditions.
1.1.2 “Contract” means the agreement between you and Eden Kitchens & Bathrooms for the sale of Goods, Design and/or Installation, incorporating these Conditions.
1.1.3 “Special Order Items” means goods that are not normally stocked and are ordered expressly for you (e.g. tiles or components “to order”).
1.1.4 “Delivery Location” means the address to which the Goods are to be delivered, as set out in your order.
1.1.5 “Made to Order” means items built, modified or personalised to your specification.

1.2 “We”, “Us”, “Our” refer to Eden Kitchens & Bathrooms, a trading entity in England & Wales (details to be inserted).

2. PRICING & PAYMENT

2.1 All prices quoted include VAT unless otherwise stated.
2.2 We reserve the right to amend or update prices at any time. Orders already paid in full will not be affected by price increases. If supplier price rises affect unpaid orders, we will inform you and offer you the choice to pay before the increase.
2.3 Orders must be paid in full either within 3 months of paying a deposit, or by 6 weeks prior to the agreed Installation date, whichever is earlier.
2.4 Special Order items, ex-display stock, or goods sold at reduced pricing must be paid in full at the time of order.
2.5 The Design Fee will be credited toward your final order.

3. DELIVERY

3.1 Delivery dates and lead times are estimates given in good faith and may be subject to change.
3.2 You must inform us of any access problems or restrictions at your property at the time delivery is arranged.
3.3 If delivery fails due to your absence or unforeseen access issues, a re-delivery charge will apply. Charges paid for a failed delivery will not be refunded if you cancel while the order is out for delivery.

4. CANCELLATION RIGHTS

4.1 Right to Cancel: You may cancel your order within 14 days from the date of making the deposit payment, without giving any reason. Notice must be given in writing to accounts@edenkitchensandbathrooms.co.uk.

Important – Design Fee Exception
Because our design work is bespoke and delivered as digital content, it is exempt from the standard 14-day “cooling-off” period under UK consumer law. Once we deliver the design content (e.g. digital plans), you acknowledge that your right to cancel that service is forfeited, and the design fee is non-refundable.

4.2 Cancellation Fees:
• You may cancel free of charge before 6 weeks before the installation date or before we order goods.
• After that point, cancellation will incur a charge of 25% of the product cost.
4.3 If installation has begun, cancellation may incur costs for work already carried out.
4.4 Refunds on cancellation will be calculated after deducting design, planning, order and restocking costs. A breakdown will be provided.
4.5 We request that you notify us as soon as possible if you wish to cancel, to minimise losses.

5. RETURNS POLICY

5.1 You may return eligible goods within 14 days of delivery (subject to exclusions in section 7).
5.2 Returned items must be in their original packaging, in a condition fit for resale.
5.3 Returns must be sent to an address designated by us.
5.4 Opened shower enclosures, doors, bath panels cannot be returned unless confirmed faulty, due to health & safety and their non-resalable condition once unpacked.
5.5 Tiles and wall panels left over cannot be returned, due to wastage and batch matching.
5.6 We will credit or refund items minus delivery/return costs.
5.7 You must return goods within 14 days after receiving notice that the return is accepted.
5.8 Items must show no signs of installation or damage.

6. DAMAGED, MISSING OR FAULTY GOODS

6.1 You must inspect goods upon delivery. Any visible damage, defects or shortages must be reported to us in writing within [insert period, e.g. 48 hours].
6.2 We do not cover damage arising from neglect, misuse or lack of maintenance by you.
6.3 Colour match limitations and natural variation disclaimers apply; these must be checked before installation.
6.4 CAD designs are illustrative; site conditions may require modifications, and we retain the right to adjust accordingly (with consultation).

7. RETURN EXCLUSIONS

7.1 Made-to-Order items cannot be returned.
7.1.1 Special Order Items (non-stocked or made-to-order) will be indicated on order confirmations.
7.1.2 You may cancel special order items up to 15 days before the agreed delivery date, subject to restocking or cancellation fees.
7.2 Once a made-to-order item is manufactured or personalised, it is non-cancellable or returnable.
7.3 Perishable goods (adhesives, grout, etc.) cannot be returned if used, deteriorated or past expiry date, or if storage is deemed improper.

8. TILES

8.1 We cannot guarantee matching of tile batches if you later request additional boxes.
8.2 Slight variations in tile dimension and colour are normal and acceptable under industry standards.
8.3 We recommend keeping extra tiles for future repairs.
8.4 Some breakage during delivery is normal; damaged pieces may be used for cuts. If breakage is unacceptable, contact us immediately for replacement.

9. INDEMNITY & RISK

9.1 Risk of damage or loss to Goods passes to you once delivered or collected (except in respect of damage caused by our installers).
9.2 We are not liable for damage to your property arising from the operation or misuse of goods.
9.3 Colour matching and wood grain variations are inherently subject to manufacturing tolerances; check before installation.
9.4 Our CAD designs are for illustration. Real-world constraints may require reasonable modifications; we will endeavour to minimise changes.

10. GUARANTEE

10.1 Products purchased directly through us for domestic use are covered against manufacturing defects (for the stated guarantee period).
10.2 Some guarantees must be registered; we will advise you.
10.3 To make a claim, contact us in writing (with order number / proof of purchase) at accounts@edenkitchensandbathrooms.co.uk.
10.4 If a fault falls within guarantee terms, we will repair or replace (in part or full).
10.5 If an identical replacement isn’t available, we may substitute an equivalent product of equal or higher value.
10.6 If the original item is found not to be faulty, we may charge for its return and costs.
10.7 The guarantee does not cover:
i. Non-domestic or commercial use
ii. Misuse or failure to follow instructions
iii. Wear and tear (e.g. seals, moving parts)
iv. Components not forming part of the material structure
v. Neglect or abuse
vi. Electrical failure
vii. Use outside the UK

11. DATA PROTECTION & PRIVACY

11.1 We will use your personal data only for fulfilling our obligations, handling payments, and (with your consent) marketing.
11.2 We will take reasonable steps to keep your data secure and confidential. You must provide accurate information and notify us of changes.
11.3 We comply with applicable UK data protection laws.

12. GOVERNING LAW, JURISDICTION, COMPLAINTS & REDRESS

12.1 This Contract is governed by the laws of England & Wales.
12.2 Disputes may be brought in the courts of England & Wales, or in Scotland / Northern Ireland as appropriate.
12.3 You may also have recourse to alternative dispute resolution or redress schemes if available.
